RULE 2.05.5 <br />POSTMINING LAND USES <br />• <br /> <br />Postmining Land Use Management. Management of reclaimed lands will be similar to the <br />management of the area prior to mining. Proper management of reclaimed lands will be stressed <br />during the liability period. Livestock grazing will begin in late July (following revegetation <br />monitoring activities) and continue into late September or early October. Where grazing occurs on <br />reclaimed and adjacent lands under Peabody's control during the liability period; area to be grazed, <br />proper stocking rates, and grazing periods will be specified to the grazing lessee. This information <br />will be based on vegetation data from monitoring studies, size of pasture units, and management <br />needs such as rest or grazing deferments. Fencing of pastures has been inplace for a number of <br />years. Two of the existing pastures overlap between the Sage Creek permit area and the SCC <br />reduced permit area (Cow Camp Pasture and Powderhouse Pasture). The pastures are illustrated on <br />Exhibit 13-13.2, "Logical Land Management Units". Results of annual grazing and management <br />will be presented in the annual reclamation reports. <br />Management of wildlife by SCC will be non-intensive and with free use of the areas by big game <br />and other species. <br />As required by Rule 2.05.5(1)(b), SCC has previously requested comments on the postmining land <br />use from the legal or equitable owners of record of the surface of the permit area and the state and <br />local government agencies which would have to initiate, implement, approve, or authorize the <br />proposed use of the land following reclamation. The owner of the land in the Seneca II reduced <br />permit area is the Colorado State Land Board. Please see various letters from the State Land Board <br />in Appendix 13-12A acknowledging the livestock grazing/wildlife habitat postmining use, and <br />requesting various permanent structures to support such postmining use. <br />PR-02 2.05.5-1 <br />I1/10 <br />
