Operative Provisions of This Lease. This Lease states the entire agreement <br />between the parties and replaces all oral and written representations, correspondence and <br />agreements related to the property subject to this Lease. No amendment or modification of <br />this Lease shall be binding unless made by a written instrument executed by Lessor and <br />Lessee and of equal formality. The terms and benefits of this Lease shall accrue to and be <br />binding on the successors, assigns, sub lessees, heirs, executors, and administrators of <br />the Parties. Lessee may not assign this lease without obtaining Lessor's written consent <br />which consent shall not be unreasonably withheld. All notices by Lessee to Lessor <br />hereunder shall be considered effective upon personal delivery or upon deposit in the U.S. <br />mail, postage prepaid, addressed to address stated herein. If there should be more than <br />one party designated as Lessor(s), notice shall not be considered sufficient under this <br />Lease unless given personally or mailed to Carl N. (Bud) Benson. If and when requested <br />by Lessee, Lessor shall execute a Memorandum Lease so that Lessee may record same <br />and give notice of the estate and rights received under this Lease without, however, giving <br />notice of the amount of the royalties and other matters hereunder which Lessee considers <br />confidential. Lessor shall not record this Lease. <br />If Lessee shall default in making any payment or in the performance of any <br />obligation hereunder, Lessor shall not be entitled to proceed with any legal remedy <br />therefore unless and until Lessor shall have first given written notice to Lessee of such <br />default sent by certified mail, return receipt requested, and shall have given the opportunity <br />Attachment 2.03.6 -1 -80 <br />
