Dear Mr. Scott,
Climax Molybdenum Corporation (CMC) has developed responses to each of the items raised in
the November 10, 2010 Adequacy Determination Letter on the Amendment AM-06 Reclamation
• Permit Amendment Application for the Climax Mine. Also included below are responses to the
supplemental comments provided in your letter dated January 28, 2011. DRMS comments are
presented in italic font, followed by the CMC response. Additional information and revised
documents, as referenced in the responses below, are included as attachments to this letter.
Copies of this adequacy response letter and attachments will also be provided to the offices of the
County Clerk and Recorder in Eagle, Summit, and Lake Counties.
Exhibit C - Pre-Mining and Mining Plan Map(s) of Affected Lands
Exhibit C (a) Comment: Please state if the area identified as "private" shown in Section 22 on
Figure C-1 (near Kokomo) is located within 200 feet of the affected area. If so, please identify the
owner of this area. Also please identify the owner(s) of the Clinton Reservoir.
Response: The area shown in Section 22 on Figure C-1 represents what is referred to as the
Connor's group of claims; a collection of claims with joint ownership. While CMC does not believe
the boundary of these claims are within 200 feet of the affected land boundary, they are very
close, and the owners of the claims were notified by letter dated September 3, 2010 as part of the
public notice process under the provisions of Rule 1.6.2.1.e(ii). Copies of these notices were
provided to the Division on October 21, 2010. The owner of the Clinton Reservoir (as identified in
Exhibit O and in the legend on Figure AM-06-C-01) is the Clinton Ditch & Reservoir Company.
