addressing my request- Perhaps it was your phone call that put it on the fast-track. In my
opinion, Wally should have responded to my request for the application on the 19'° or
sent someone else to verify the application was in fact there.
Wally's response was that the application was there on the 26a' and his statement that
it was available on the 19'h is false and unacceptable. I find it inappropriate and
personally offensive to be portrayed by Wally as alleging the application was there and I
was not telling the truth.
I would like to request a written apology for this poor choice of words and a
correction to Wally's false report.
Time and time again in the processing of Wildcat's application, the DRMS response
to citizens requests and complaints has been delayed and the response questionable from
my perspective. These delayed responses have allowed Wildcat Mining Corp. to ignore
DRMS regulations with the knowledge that DBMS staff will not be coming any time
soon. I believe these delayed responses from DRMS have been very costly in both time
and money. It has allowed a permit that was fairly simple and limited to explode into a
very complicated and expensive one for the people of Colorado. I would also like to
request a formal audit of the Wildcat Mining Corporations activity and the Division's
actions back to 2006. It appears Wildcat Mining does not have any violations prior to
2009. During the summer of 2006 Wildcat Mining constructed a mine site that included
a processing plant, rock crusher, excavation of old tailing ponds and road construction.
They did not even have an application on file at that time. Was there no violations
recorded because there were no citizen complaints? I know the DRMS Environmental
Specialists; Kate Pickford was on site more than once. In fact one memorable visit was
when Kate Pickford was riding around in the applicant's pickup and they were actually
ticketed by the United State Forest Service Ranger for driving their pickup off road on
National Forest land. Kate's behavior did nothing to encourage my hope that DRMS
employees were interested in protecting the local surrounding environment.
I have reviewed legislative declaration in section 34-32-102 for mining in the state of
Colorado. This mandate defines mining and reclamation to be both "necessary and
proper." While I won't argue it being "necessary," I do question groper" in this case.
Wildcat Mining Corporation's approach to mining in Colorado has been anything but
