January 27, 2011, A.M. - Phone conversation with Mr. Vigil, follow-up from previous
evening's message. Everything seemed worked out and understood.
January 28, 2011, A.M. - Phone message from Mr. Vigil, inquiring how many violations had
been issued for Wildcat Mining Corporation. After conducting a file review I called Mr. Vigil
back and left message indicating five violations being issued to Wildcat Mining Corporation.
January 28, 2011, P.M. - Mr. Vigil returned my call and was incredulous that MLRB had
issued only five violations. Mr. Vigil insisted there had to be more, maybe before I became
involved. Mr. Vigil stated he remembered more violations. While Mr. Vigil was on the line I
consulted Permit System database and read the five violation numbers, with clarification that
MV-2009-007 and MV-2009-033 were for the Idaho Mine, File # M-2006-069; and MV-2009-
035, MV-2010-001 and MV-2010-020 were for the May Day Mine, File # M-1981-185. I clarified
there had been three previous violations at May Day, MV-1990-085, MV-1992-072 and MV-
1996-018, all dealing with failure to pay annual fees/submit annual reports, but for a previous
Operator. Mr. Vigil refused to believe only five violations had been issued to Wildcat. I
suggested that other agencies may have issued violations as well.
January 31, 2011, A.M. - Phone message from Mr. Vigil, indicating receipt of my January
26th correspondence in which 1 stated "allegations are false". Mr. Vigil stated such language
was the same as calling him a liar.
January 31, 2011, P.M. - Phone conversation with Mr. Vigil, regarding his earlier message
and interpretation of my January 26`h correspondence. See attached email message in which I
informed my supervisors and AGO of the unsuccessful communication.
