RECEI1 <br />FEB 18 2011 <br />Division of Reclamation, <br />Mining and Saf6ty <br />F , 8 <br />DATE: January 31, 2011 <br />FROM: Wally Erickson <br />RE: Phone Conversations and Written Communications with Phil Vigil, <br />Application to Convert 110(2) Operation to a 112d Operation (CN-01), <br />May Day Idaho Mine Complex, M-1981-185.x`` <br />Given the tone of recent communications with Mr. Vigil, I considered it prudent to construct <br />the following memo from my phone notes and memory. <br />January 20, 2011, A.M. - Phone conversation with Mr. Vigil regarding public documents at <br />the La Plata County Clerk and Recorder's Office. Mr. Vigil indicated that he had visited the <br />Clerk's office on January 19 and had been confused by the number of documents/applications <br />on file for Wildcat Mining Corporation. Mr. Vigil indicated that he had observed several 110(2) <br />applications and a 112d.] clarified that the 112d was the current application being reviewed <br />and the 110(2) were older applications no longer being reviewed. I clarified that the 112d <br />included two three ring binders. Mr. Vigil indicated that he had seen one binder marked 112d <br />but did not remember if there was a second. <br />January 20, 2011, P.M. - Phone message from Mr. Vigil, inquiring which files at the Clerk's <br />office address the current application. Since we had just discussed the issue earlier that day 1 <br />did not return Mr. Vigil's message. <br />January 21, 2011, A.M. - Phone message from Mr. Vigil, indicating that he found binders <br />dated June 22, 2010, at the Clerk's office. Since I had previously clarified which file was the <br />current application I did not return Mr. Vigil's message. <br />January 26, 2011- Received letter from Mr. Vigil, dated January 24, 2011, in which Mr. Vigil <br />alleged the absence of the appropriate files at the Clerk's office. Two additional letters were <br />received, from Lisa Giovanniello and Poppy Harshman, raising the same allegation. In response <br />to written complaints 1 immediately visited the Clerk's office and verified the presence of the <br />appropriate files. On January 261 responded to the written complaints. <br />January 26, 2011, P.M. - I called Mr. Vigil, in response to a phone message he had left with <br />Loretta Pineda, DRMS Director, regarding files available at the Clerk's office. Mr. Vigil did not <br />answer and I left a message indicating that I did not appreciate him calling others with the same <br />questions I had already answered on January 20. 1 stated that I had visited the Clerk's office <br />and verified the presence of the appropriate files for the 112d application.
