6) Please provide damage waivers or agreements with Excel Energy and Western Slope <br />Gas for the installation of (5) 4' culverts through the identified easements for water <br />pass through from Lakes 2 & 3 to Lake 1 per Rule 6.4.19(c). <br />7) Mining Map, C -2 shows 2 culverts between Mining Area 1 and Mining Area 3. <br />These culverts are not shown on Map F, The Reclamation Map. Staff cannot <br />identify in the text where and when these will be removed. Please Clarify if the <br />culverts are to remain or be removed. <br />8) Please identify on Map C -2, the exact location of the proposed dike cut, back to the <br />original drainage, in the Area 1 Lake. Also address erosion control and construction <br />details for this structure. <br />9) The Mining Plan states that Lake 1 or 2 will be temporarily drained to facilitate the <br />construction of industrial pads. Water from the drainage project will be pumped into <br />the constructed sedimentation pond. Please clarify that outflows and inflows will be <br />balanced since it is obvious that there is not enough capacity in the sediment pond <br />for water from either lake. <br />10) Please specify if explosives will or will not be used per Rule 3.4.4(1). <br />11) Exhibit E, The Reclamation Plan states a volume of 90,088cy of topsoil is <br />required to cover 83.76 acres. Staff's calculation of 83.76 X 43560 / 27 X .75 (8" <br />cover) = 101,350 CY. Please clarify the difference of 11,261.6 CY of topsoil. <br />12) The seed mix for the reclaimed wetland / slope areas do not contain any <br />shrubs or trees. Please clarify the justification for this or add in some compatible <br />woody species for wetlands / wildlife benefit. <br />13) The Mining of Area 5 will require the movement of topsoil and overburden to <br />other areas. It is understood that some will be used to construct other pads in other <br />areas. However, where will excess topsoil /overburden be stored, once these other <br />areas are constructed, for Area 5 reclamation? Please clarify and note on Mining <br />Maps if necessary. <br />14) The Mining Plan states that Areas 1,2 or 3 will be used as a processing area <br />during mining of Area 5. If these areas are already reclaimed is it the operator's <br />intent to re- disturb these areas? If these areas are not reclaimed or re- disturbed, <br />then the cost for reclamation should be reflected in the "worse case" as additional <br />reseeding areas. Please clarify. Staff will need to know approximate surface area <br />for processing area for bond calculations. <br />15) Please supply documentation of an agreement with Grand Junction Drainage <br />District concerning the relocation and disturbance of their irrigation return canal <br />system per Rule 6.4.1 9(a). <br />16) The Geotechnical Stability Exhibit states that a 30' buffer will be maintained <br />around the permit boundary line. Please clarify if this pertains to all easements <br />within the boundary as well. <br />17) Enclosed is a copy of the State Engineer's "conditions for approval ". Please <br />address the concerns of this Office. <br />
