Savage and Savage Environmental <br />practical solutions for environmental issues <br />4610 Haystack Drive 970 674 8080 telephone <br />Windsor, Colorado 80550 970 674 8088 facsimile <br />savageandsavage( earthlink.ne.U,E1drG'D <br />February 16, 2011 <br />EBB 17 ZMA <br />n1iSCllr1? <br />Tom Kaldenbach, Environmental Protection Specialist ? <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re: Carbon Junction Mine (CDRMS permit C-92-080) Midterm Permit Review #4 <br />Dear Tom: <br />I have conducted a brief review of the Division's mid-term review document for the mine on <br />behalf of Oakridge Energy, Inc. and have some questions regarding the calculation of the <br />reclamation bond amount. <br />SUMMARY TABLE (pages 1 and 2) <br />In the summary table for the reclamation bond calculation, the Division has retained 100% of the <br />calculated bond amount for several tasks that have either been completed or are otherwise no <br />longer applicable. <br />In the section titled "Equipment Storage Yard at south end of permit area", tasks 042, 043, 044, <br />045, and 052 reflect reclamation tasks at the equipment storage area. All tasks have been <br />completed, yet the Division retains 100% of the calculated bond amount. This is not appropriate. <br />In the Findings of Compliance and Proposed Decision of Phase I Bond Release SL-3, Carbon <br />Junction Mine Permit No. C-92-080, dated April 21, 2008, the Division stated in Section V.; <br />"This proposed decision will release Oakridge from liability for backfilling, grading, and <br />drainage re-establishment in the following areas: the former North Pit mining area, the North <br />Pit Haul Road, the Permanently Reclaimed Spoil Area (PRSA), Topsoil Pile #2, the South Pit <br />Drill Pad, the Equipment Yard Area [emphasis added], the Carbon Junction Channel, and <br />ancillary adjacent areas. "... "Reclamation liability also remains for removal of equipment stored <br />in the Equipment Yard. " <br />With the above finding, the Division should amend the bond calculations for tasks 042, 043, 044, <br />045, and 052 to reflect the release of liability and bond for the reclamation in the Equipment
