5.) Two issues from the Division's Third Adequacy review were not addressed in your <br />response. They are listed here, please address: <br />a. It appears the applicant is relying on a ditch south of Cell A and west of the <br />southern portion of the Western Mutual Ditch to alleviate groundwater mounding <br />at the southern end of the site. Please indicate if the ditch is lined, or if it is <br />permeable to accommodate groundwater interception. During the pre-operation <br />inspection, it appeared the ditch was lined with concrete. If the ditch is lined, <br />and/or it needs to be improved to function as a groundwater drain, please provide <br />plans and specifications of these improvements. The applicant must demonstrate <br />those improvements will allow the ditch to alleviate groundwater mounding. Or, <br />they must demonstrate the ditch currently has the capacity and design to alleviate <br />groundwater mounding. <br />b. If the southern ditch is unlined, it may be prone to erosion if the flow rates <br />exceed the carrying capacity of the ditch. The applicant should submit <br />documentation to the Division for review as to the proposed maximum flow rate <br />of the ditch and specifications as to how much water the ditch can carry without <br />experiencing erosion. Or portray and describe how the ditch will be protected <br />from erosion and still remain permeable for groundwater interception. <br />Site Preparation Phase 1- Water Control Plan <br />6.) Included with the adequacy response was an amendment to Exhibit G titled "Water <br />Information - Groundwater Control Measures". This exhibit included several maps titled <br />"Site Preparation Phase 1". Please indicate when the "Site Preparation Phase 1" <br />operation will be conducted. Also, please include a narrative that specifically identifies <br />all the activities to be conducted as part of the site preparation. <br />7.) Please provide specifications and designs for the proposed "Drainage Outfall to the <br />River" structures. <br />8.) The site preparation maps indicate several areas will be used for soil/spoil storage. How <br />long will this material be stockpiled? How will the stockpiles be configured and <br />stabilized to protect against wind and water erosion? <br />9.) Map P1-5 indicated two ponds will be created or have already been created. The map <br />also indicates there is an existing pump/well in this location to be used for construction <br />purposes. Will water be impounded in these ponds for longer than 72 hours? If so, does <br />the current approved temporary substitute water supply plan cover the evaporative loss of <br />the impounded water? Please submit documentation that the Operator has adequate water <br />rights and that the water from the pump/well is approved to be used for construction use. <br />6.4.19 EXHIBIT S - Permanent Man-Made Structures <br />10.) According to the response to item 20 of the Divisions Adequacy Review. The applicant <br />committed to not mining within 200 feet of the following structures: <br />a. Structure #2; Oil/Gas Wells and Facilities owned by Petro Canada <br />b. Structure 47; Utility Line owned by Xcel Energy <br />c. Structure #8; Buildings owned by Ptasnik Land Company <br />it appears the owner for Structure #2 has changed to Noble Energy. Please commit to <br />marking these structures in the field, as well as the 200 foot setback until the structure <br />damage reimbursement agreements have been submitted and approved by the Division.
