Pineda <br />Frederick, Colorado 80530 Director <br />RE: S & H Mine; DRMS File No. M-2000-158; Amendment 02, Adequacy Review #4 <br />Dear Mr. Hagen, <br />The Division of Reclamation, Mining and Safety (Division) has completed its review of your <br />adequacy review response letter and conducted a financial warranty estimate based on the <br />information supplied. The items discussed below will need to addressed prior to the Division's <br />approval of the amendment application. The decision date for the amendment application is <br />February 28, 2011 per your extension request. Please be advised that if you are unable to <br />satisfactorily address any concerns identified in these reviews before the decision date, it will be <br />your responsibility to request an extension of the review period. If there are outstanding <br />issues that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. Pursuant to Rule 1.4.1 (9), <br />the review period cannot be extended beyond 365 days from the date the application was filed. <br />This deadline is March 1, 2011. <br />6.4.5 Exhibit E -- Reclamation Plan <br />1.) Please identify the purpose of the buried riprap dikes depicted in the Permanent Erosion <br />Control Plan? <br />2.) The Division approves of the proposed weed control plan for the site. During the site <br />visit on February 3, 2011 is appears a significant effort to treat noxious weeds occurred. <br />The Applicant may want to consider conducting a temporary grass seeding in these <br />treated areas to promote non-noxious weed establishment. If the site will be inactive for <br />four or five years, without competitive vegetation the noxious weeds will return with <br />added vigor enhancing the cost and time to treat the infestations. <br />6.4.7 Exhibit G - Water Information <br />3.) Please indicate how frequently and for what duration baseline groundwater data will be <br />collected. At a minimum, the Division will require monthly monitoring for 12 months. <br />Please commit to submitting baseline groundwater monitoring data to the Division prior <br />to installing the slurry walls. Also, please commit to identifying what groundwater <br />elevation(s) will be the benchmark for the two foot trigger point outlined in the response <br />letter. <br />4.)
