Walcher
Executive Director
Hal D. Simpson, P.E.
State Engineer
Kenneth A. Beegles
Division Engineer
This is a note confirming any understanding of the plan for reclamation of the gravel pit on Pat Greer's
property along the La Plata River. You have requested to finish the project with an isolated pool that Mr.
Greer may use for a fire pond.
In the latest plans (received December 12, 2001), you propose to fill in large sections of the shallow
areas of the pit and to fill in the pit on the west side. You have proposed to install a drain for the exposed
spring, which should convey gravity flow water in the 8" PVC pipe to a point on the southwest site of the pit
and drain to the stream, which is directly across the roadfill into the La Plata River. A valve would be
constructed which could be used to fill the pond. It is our understanding from field reports that the pond is
sealed and was dry during the gravel removal operations other than water exposed at the subject spring. No
exposure of groundwater will be made except when available out of the stream.
It appears that the proposed reclamation will work without causing injury to the stream or Compact
administration if properly regulated. This office may at some later date need to re-evaluate the pit for
groundwater and will need to have measuring devices installed to report the diversion and use of the pond
water. A dewatering well permit may be required for the diversion into the drainage pipe. Mr. Greer may
wish to file for the pond use as a water right once the system is in place.
At this time we believe the reclamation can proceed as designed. I have reviewed this proposal with
our office in Denver and we will work with you to allow this completion scenario. Please let us know when
the pipeline is to be installed. A final pond area capacity curve would be desirable. Please call if you have
any questions.
Cc: Pat Greer
Russell Kennedy
Matthew Schmitt
Sincerely,
rKBeegles
Division Engineer
