PERMIT #: M-1977-393 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: January 11, 2011 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Bob Crifasi and Paul Rovnak of the City of Boulder were also present for the inspection. The Jenkins <br />Site is located approximately 3 miles south of Superior, Colorado. The site is permitted for 233 acres and the <br />post-mining land use is rangeland. <br />Mining at the Jenkins Site is complete and reclamation of the site is underway. Reclamation efforts are <br />focused on a one acre parcel of land located at the north end of the permit area. The Operator is currently <br />backfilling a previously excavated area with inert backfill material to create the required 3HAV slopes. The <br />backfill material comes from City of Boulder construction projects as it becomes available. A bald eagle's nest <br />was identified along Coal Creek, immediately south of the backfill area..As a result, the site is closed from <br />November through July of each year during the eagle's nesting period. The City of Boulder has a three month <br />window each year to complete reclamation work; progress is dependent upon available backfill material <br />during this period. <br />Reclamation work has been ongoing for over the past five years. Rule 3.1.3 of the Construction Materials Rules <br />state that all reclamation shall be carried to completion by the Operator with all reasonable diligence, and <br />each phase of reclamation shall be completed within five (5) years from the date the Operator informs the <br />Board or Office that such phase has commenced. The failure to reclaim the site within five years has been <br />cited as a problem and will require corrective action by the Operator; please see the first page of this report <br />for the required corrective action. <br />This concluded the inspection. <br />Page 2 of 4
