Hard Rock/Metal Mining Permit Application <br />Limited Impact Designated Mining Operation (I 10(d)) <br />Venture Resources, Inc. - Robert Fulton Reclamation <br />Revision 0: JanuaKy 17, 2011 <br />Exhibit L <br />As per Rule 6.3. 12 of the Mineral Rules and Regulations, this Exhibit L shall be the necessary engineering <br />evaluation that demonstrates any permanent man-made structures located within 200 feet of the proposed operation <br />and affected area will not be damaged by the proposed operation. <br />Rule 1.1.51 defines a permanent man-made structure as follows: <br />Structure, Significant, Valuable and Permanent Man-made" means a non-portable <br />improvement to real property which has defined, current and recognizable value of <br />an economic nature; generally including but not limited to: buildings, houses, barns, <br />fences, above or below ground utilities, irrigation ditches, maintained or public roads, <br />bridges, railroad tracks, cemeteries, communication antennas, pipelines, water wells, <br />water storage structures, discharge and conveyance structures, etc. <br />It shall be reiterated that NO underground mining activity is proposed for this operation. A pre-existing mine waste <br />rock dump is being removed from its surface location. <br />It has been identified that the only pennanent man-made structures that exist within 200 feet of the proposed <br />operation are: <br />• Public road, Virginia Canyon Rd. This road is designated by Gilpin County as a public roadway <br />o This main access road is a public, county maintained road. Currently, the road averages 25 - 30' <br />in width and is constructed of what appears to be Class 5 road base; it is not paved in this area of <br />Gilpin County. This road has historically been used for the mining industry. <br />• I-listoric mine access road. <br />o The subject site is accessed from Virginia Canyon Rd. via an historic mining road. Currently, the <br />road averages 10 - 12' in width and is constructed of native materials developed during its <br />construction. There is no evidence of any significant improvements or County maintenance of this <br />road in several decades. This roadway does not continue through to any other road systems. It <br />was built solely to access the historic mine operation. <br />• 25kV overhead electric utility, owned by Xcel Energy. <br />o Excavating equipment will not be operating directly underneath overhead utilities. The closest <br />overhead lines bear 55' to the south. <br />• Overhead telecomununication line, sharing ROW with Xcel Energy on electric utility poles. <br />o Excavating equipment will not be operating directly underneath overhead utilities. The closest <br />overhead lines bear 55' to the south. <br />• Underground natural gas distribution pipeline, underneath Virginia Canyon Rd. ROW. <br />o Excavating operations will not impact Virginia Canyon Rd. or the buried gas line beneath it. The <br />excavating operation occur 425' to the northeast of this utility. <br />These structures can be readily identified in Exhibits A & E. Prior to beginning actual excavation operations, <br />Venture Resources will be required to do a final underground utility locate as required by CO law. <br />Page 1 of 2
