Please note that the proposed overburden stockpile must comply with the <br />applicable performance standards of Rule 4.09.1. Please revise the PAP to address these <br />requirements. <br />3. Subsection 2.05.3(6)(a) Overburden Blasting has been provided with the application. The <br />Division has no comments regarding this section at this time. <br />4. Rule 4.08.2(1) requires that owners of structures within %2 mine of the permit area <br />(emphasis added) be notified. The blast notification envelope circumscribed on Map <br />2.05.3(6)(a) -1 appears to have been determined using the blasting area. Please revise the <br />notification envelope to include all structures within 1 /2 mile of the propose NHN permit <br />area. <br />2.05.4 — Reclamation Plan <br />2.05.40 (c) — Backfilling, soil stabilizing, compacting, grading, post- mining contours, stream <br />channel reconstruction, and road removal or modification <br />5. The cross sections provided on Map 2.05.4 -1 do not appear to completely portray the lateral <br />limits of the permit area. Please extend the limits of the cross sections to clearly show the <br />County Roads adjacent to the mining; the right -of -way; any buffer (25 feet ?) between the <br />disturbed area and the right -of -way; and the location of the Haul Roads. <br />2.05.6 — Mitigation of the Impacts of Mining Operations <br />2.05.6 1 Air pollution control plan <br />As stated in the application, WFC has submitted an application to the Colorado Department <br />of Public Health and Environment (CDPHE) Air Pollution Control Division (APCD) for an <br />emissions permit. Please provide a copy of the permit, when issued, for inclusion within the <br />PAP. <br />2.05.6Q) — Fish and wildlife plan <br />The Division will be contacting the Colorado Division of Wildlife to obtain the agency's <br />written approval of (or any comments on) the proposed plan. <br />2.05.6 (3) — Protection of hydrological balance <br />9. WFC provided a detailed analysis of the "Probable Hydrological Consequences of Mining' <br />in the application package. Substantial discussion and analysis is provided for spoil springs <br />tributary to Tuttle Draw. But very little analysis was provided for the predicted spoil springs <br />that may be tributary to Meehan Draw from the mineable block located to the north of <br />Meehan Draw. The Division has identified this as a potentially significant impact and an <br />adequate analysis is not provided. Springs tributary to Meehan Draw are first mentioned on <br />
