Pi6eda
Director
Re: Mesita Hill Pit, Permit M-1977 S9, Technical Revision TR-2, Second Adequacy Review Letter,
and Extension of Decision Date. Z-
-Z--+-Dear Mr. Glader,

Thank you for the prompt reply to my earlier review letter concerning Technical Revision TR-2 for the
Mesita Hill Pit. The responses you sent answered nearly all the Division's adequacy questions. There are
still a few unaddressed adequacy issues, of which you are aware. The outstanding adequacy issues are
listed in the numbered paragraphs below. Please respond to each of the adequacy concerns below. (Please
note that some of the numbered items are the Division's comments and do not require responses from you.
The numbers below correlate to those in the first letter.)
In order to allow sufficient time to address those items you have requested that the Division's decision date
be extended till February 28, 2011. I am approving your request to extend the decision date, and it has
been reset to February 28, 2011.
1. The proposed demolition and capping of the concrete is adequate for the reclamation plan.
2. The concrete pad and the bin walls still exist at the site, and it was stated that they will remain to
facilitate future handling of the fines that exist in the stockpiles there, whether or not MWCA sells
the fines. The demolition and burial of the concrete, and grading of the slopes of the unsold
stockpiled material are understood to be parts of the reclamation plan, and therefore must be
performed eventually. Likewise, there must be a permit for this site as long as materials will be
sold from the site. From your statement it appears that MWCA may wish to transfer the permit to
another party. Please clarify.
3. See comment in number 1, above. Please ensure that the capping material is graded to conform to
the approved reclamation slope gradient of 3:1.
4. The clarification regarding the electric infrastructure is sufficient; the structures will remain.
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
