and 59a (Soil Redistribution Plan) contain information on soil depths and volumes that were to <br />be removed and replaced throughout the permit term. Soils in the 720 Pit were salvaged prior to <br />promulgation of the Colorado Surface Coal Mining Reclamation Act, and six inches of material, <br />regardless of suitability, were salvaged. In general, six inches of topsoil were salvaged from Pit <br />1 and required to be replaced (page 816-126). The Division dug several pits to verify topsoil <br />depths during the partial Phase II Bond Release inspection (for SL-01) on May 22, 2001 and <br />measured an average topsoil depth of 7.5 inches. Topsoil at the loadout was not extensively <br />salvaged. The topsoil that was salvaged has been replaced and appears to be adequate to support <br />the growth of vegetation. Kerr Coal Company also transported topsoil that was to be used for <br />pond reclamation at the mine site to supplement the topsoil at the loadout. <br />The revegetation plan calls for drill seeding an annual cover/mulch crop of Russell oats in the <br />spring or Elbon winter rye in the fall. This is to be followed in the subsequent fall or spring with <br />a separate seeding of grasses and forbs. The reclamation and seeding of the 720 Pit was <br />completed in 1995 and the reclamation and seeding of Pit 1 was completed in 1996. Seeding at <br />the loadout was completed in 1999 and a Phase I Bond Release, SL-02, for the area was <br />approved by the Division on June 26, 2001. <br />The current permit application specifies that in order for Kerr Coal Company to open either Pit 2 <br />or Pit 3, both of which are proposed to lie to the north of Pit 1, the company must submit a <br />permit revision application (pages 780-1 R, 2Ra, and 5R of the application). <br />List of Revisions <br />The following is a list of permitting actions have occurred since the March 17, 2006, permit <br />renewal. <br />1. Permit Revisions <br />None. <br />2. Technical Revisions <br />a. Technical Revision TR-22 was submitted on February 16, 2006, found complete on April <br />27, 2006, and proposed for approval on September 26, 2007. This revision approved the <br />retention of Pond F as a permanent pond in support of the post-mining land-use of <br />rangeland and wildlife habitat. <br />b. Technical Revision TR-23 was submitted on June 15, 2007, found complete on June 25, <br />2007, and proposed for approval on September 26, 2007. This revision approved <br />termination of water and vegetation monitoring at the mine site and approved permanent <br />retention of two light use roads in support of the post-mining land-use. <br />c. Technical Revision TR-24, submitted on May 18, 2009, would have made the pond at the <br />Marr loadout a permanent structure. This revision was withdrawn on February 1, 2010. <br />13
