We are aware of and understand the <br />mine and reclamation opcmtiun for the subject property in the South % of the NW '/. Section 8 in'l'ownship 49 North, <br />Range 9 East of the New Mexico Principal Meridian and have talked with a representative of James L. Treat regarding <br />these operations. We have no problem with the operations being proposed by Jaynes L. Treat and have been assured by <br />James L. Treat that should any damage occur to our structures and improvements due to the proposed operations, James <br />L. Treat will fully repair any such damage at its expense or provide full compensation for any damage. James L. Treat <br />agrees to maintain a 25 foot setback from any utility structure. <br />The signature of tie James L.
