TWENTYMILE COAL, LLC - FOIDEL CREEK MINE <br />PERMIT NO. C-82-056 <br />MID-TERM REVIEW RESPONSES -12/06/10 <br />1) Rule 2.03.4(6). Page 2.03-14, the address for Camilletti & Sons has been changed. Please ensure <br />that the contact information for all land owners is current. <br />Response: The Rule 2.03 landowner information has been reviewed and updated, as appropriate. <br />Copies of the revised and updated pages accompany these responses for insertion in the PAP. <br />2) 2.03.5(3). Page 2.03-19.1 needs to be revised to change the date of the penalty payment received <br />for NOV CV-2008-006 from October 15, 2007, to February 11, 2009. Also, previous violations <br />not received within the past three years may be deleted. <br />Response: The noted revisions have been incorporated. Copies of the revised pages accompany these <br />responses for insertion in the PAP. <br />3) Rule 2.04.3(4). Page 2.04-3 references Table I for statistics of cropland yields "for the past nine <br />years. " However, Table 1, revised with RN5 does not reflect the statistics given on Page 2.04-3. <br />Please update the text to correspond with Table 1. <br />Response: The noted revisions have been incorporated. Copies of the revised pages accompany these <br />responses for insertion in the PAP. <br />4) Edit. Pages 2.04-16.4 and 2.04-15.5 revised with PR09-08 (04110109) should be changed to 2.04- <br />16.3 and 2.04-16.4 to correspond with existing text pages. <br />Response: The noted revisions have been incorporated. Copies of the revised pages accompany these <br />responses for insertion in the PAP. <br />5) Rule 2.05.3(2). Page 2.05-3 indicates that the mine permit area encompasses approximately <br />21,720 acres, with 13,090 affected acres, and 510.4 disturbed acres. These numbers are in <br />contrast to the Division's numbers of 19,940 permitted acres, 19,471.85 affected, and 616.72 <br />disturbed. Please clarify the correct number of acres the mine permit encompasses, or address <br />discrepancies with the Division's acreage amounts. <br />Response: In order to address identified inconsistencies in the acreages figures for the "Permitted", <br />"Affected", and "Disturbed" areas, TC digitized the Permit Area Boundary and the "Affected Area" <br />boundary from the most recent update (PR09-08, 09/09) of the Mine Plan Map (Map 23). The <br />digitized Mine Permit Area is 22,447 acres (show as 22,450 acres), and the digitized "Affected Area" <br />is 14,376 acres. The "Affected Area" also includes any "Disturbed Areas" that are not within the <br />digitized "Affected Area" footprint, or +524.2 acres, so the total "Affected Area" is 14,900 acres. <br />The total permitted "Disturbance Area" is 609.4 acres. This figure reflects reconciliation of the <br />disturbed area acreage in conjunction with the 2009 Annual Reclamation Report, and the additional <br />disturbance permitted through revisions during 2010. Those PAP pages which include relevant <br />acreage figures have been updated to reflect these figures, and copies of the revised pages accompany <br />these responses for insertion in the PAP.
