In addition, if water rights are involved, then, those rights need to <br />be protected under Rule 4.05.15. Please revise the text where necessary. <br />15. Map 2.05.3(3)-1, "Surface Water Hydrology", has several depictions that are not explained, <br />either on the map or in the map legend. Such depictions include the black, blue, dark orange <br />and magenta colored lines, as well as the mine plan year numbers 2013 through 2018. Under <br />Rule 2.05.3(3) and (4), please add labels on the map or explanations in the map legend that <br />describe what the depictions represent. <br />16. On Map 2.05.3(3)-1, "Surface Water Hydrology", the green lines that depict the collection <br />ditches are obscured in some areas by the magenta lines. Also, the ditches' names are not <br />shown. Under Rule 2.05.3(3) and (4), please revise this map to show the full extent of the <br />collection ditches and the appropriate ditch names. <br />17. In the last sentence on page 6 of the Protection of the Hydrologic Balance section of 2.05.6(3), <br />it is stated that some of the surface water monitoring sites may be relocated as the mining <br />progresses. The Division is concerned that the relocation of monitoring sites may result in a <br />lack of continuity in the monitoring program. Please explain which monitoring sites may be <br />moved and if there are replacement monitoring site locations that would not require relocation. <br />18. On page 7 of the Protection of the Hydrologic Balance section of 2.05.6(3), it is stated that the <br />stream buffer zones along Nygren Draw, Meehan Draw and Glasier Draw will not be affected <br />by mining- related surface disturbances. Please describe on page 7 of Section 2.05.6(3) the <br />measures that will be used to ensure compliance with Rule 4.05.18. Before the Division can <br />make a proposed decision on the new permit application, the Division will need this <br />information when it makes its findings of compliance with Rule 4.05.18. <br />19. In the second full paragraph on page 8 of Section 2.05.6(3), it is stated that calculations were <br />made that determined that there would not be significant impact to receiving stream water <br />quality and water rights due to mine discharges. Please provide the calculations or reference on <br />page 8 where in the permit application these calculations can be found. <br />20. In the second full paragraph on page 8 of Section 2.05.6(3), it is stated that present or potential <br />uses of the water were not considered in the determination of no significant injury to receiving <br />stream water quality and water rights due to mine discharges. Please explain why present or <br />potential uses were not considered. <br />21. In the second to last paragraph on page 8 of Section 2.05.6(3), it is stated that WFC will file for <br />an augmentation plan with the Water Court. Please provide a copy of the augmentation plan to <br />the Division when it is approved and reference the location of the plan on page 8. <br />22. In the top paragraph on page 9 of Section 2.05.6(3), it is stated that WFC plans to operate a <br />Substitute Water Supply Plan. Please provide a copy of the plan to the Division when it is <br />obtained and reference the location of the plan on page 9.
