(Al) is the operator of recor under Division of <br />Reclamation, Mining and Safety (DRMS) 112c Permit No. M 1999-021 - Stegner Farms. <br />As such, DRMS provided to Al a copy of Larimer County's notice of hearing in the <br />above-referenced matter together with a copy of the proposed Special Review (SR) <br />amendment application as submitted to the Planning Department by Banks and Gesso <br />LLC on behalf of Trollco, Inc. While DRMS had been advised during an inspection of <br />the site on January 12, 2010, at which a representative of Trollco was in attendance, that <br />a Succession of Operator (SO) for the DRMS permit from Al to Trollco would be <br />forthcoming, they have not received the SO and are now inquiring about the status of that <br />transfer in light of Trollco's County amendment application. <br />AI's occupancy of the Stegner site was terminated as of December 31, 2009, and as noted <br />in Trollco's SR amendment application, Al no longer has access to the site. Following <br />AI's exit from the site, Al and Trollco entered into an agreement which acknowledged <br />that Al had completed its reclamation obligation under the direction of and to the <br />satisfaction of Trollco in accordance with agreed upon physical field reclamation actions. <br />The agreement provided that, upon execution, the SO from Al to Trollco of the DRMS <br />-permit would be submitted to DRMS. To date, Trollco has failed to fulfill its obligations <br />by refusing to complete and submit to DRMS the SO application together with the <br />appropriate performance and financial warranties for reclamation of the site. <br />The current reclamation financial warranty obligation under the DRMS permit for the <br />Stegner mine is $63,401. This amount was based on site conditions as they existed <br />following AI's December 31, 2009 exit from the site as determined by DRMS during the <br />January 12, 2010 inspection.
