Compliance With Mine Plan <br />NA - Support Facilities Not On -site <br />R - Other <br />NA - Special Categories Of Mining <br />R - Processing Waste <br />Y -Topsoil <br />COMMENTS <br />INTRODUCTION <br />This was a complete inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division of <br />Reclamation, Mining and Safety (DAMS) on December 9, 2010. Sandra Brown, Brock Bowles, and Stephanie <br />Reigh from the DRMS Denver office were also present. No representative from McClane Canyon Mine was <br />present during the inspection; however, we did speak with April Schultz HR/Administrative Assistant at the <br />McClane Canyon Mine office prior to the inspection. Weather conditions were cloudy and cool. Ground <br />conditions were damp and muddy in some areas particularly around the portals area. Coal was not being conveyed <br />from the mine and the mine had shut down their operations on 12/9/10 according to April Schultz. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The availability of records was checked at the mine office on the afternoon of 12/9. The third quarter 2010 <br />discharge monitoring records and the third quarter sediment pond inspection reports were not on file. Also the <br />Insurance Certificate has expired and a current certificate needs to be added to the files. Please update the records <br />files accordingly. All other required records were available for review at the time of this complete inspection. See <br />the attached records checklist at the end of this inspection report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />❑Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, <br />4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring <br />4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />A rock fall occurred recently (just prior to this inspection according to site personnel) at the location of the large <br />diversion structure located in the drainage behind the exhaust fan. A large rock slab fell into the drainage area and <br />part of the rock hit the side of the diversion structure (see attached Photograph No. 1). There does not appear to be <br />any damage to the diversion structure and MCM is planning to break up the rock fall material and remove it from <br />Number of Partial Inspection this Fiscal Year: 3 <br />Number of Complete Inspections this Fiscal Year: 2 <br />Page 2 of 6 <br />
