Technical Revision No. 39 was approved on March 19, 2009. The revision incorporated <br />groundwater points of compliance to comply with Rule 4.05.13. <br />Technical Revision No. 40 was also approved on March 19, 2009, and incorporated the as-built <br />certification of Pond 012A. <br />Technical Revision No. 41 was approved on August 2, 2009 and discontinued wildlife monitoring <br />at the site, since surface coal mining operations had ceased. <br />Technical Revision No. 42 was approved on October 8, 2009. The revision provided <br />supplemental information on the Pond 012 slide remediation plan. <br />Technical Revision No. 43 was approved on October 1, 2009 and included plans for additional <br />measures to be used to stabilize post mining drainage channels. <br />Technical Revision No. 44 was approved on September 29, 2009 The revision allowed for three <br />small area exemptions (from the requirement to direct all disturbed area runoff to a sediment <br />pond) to divert runoff away from Pond 012 and the Pond 012 slide area. <br />Technical Revision No. 45 was approved on April 15, 2010 and provided an update to the <br />adjudication file in the permit application package. <br />Technical Revision No. 46 was approved on May 7, 2010 and provided additional information on <br />the Pond 012 slide remediation plan. <br />Technical Revision No. 47 was approved on May 4, 2010. The revision allowed for reduced <br />hydrologic monitoring at the reclaimed mine site until the final year prior to bond release. <br />Technical Revision No. 48 was submitted on April 9, 2010 and is currently under review. The <br />revision would change the woody plant density standard for reclaimed areas. The application <br />was initially deemed incomplete, but was found to be complete on June 24, 2010. <br />Technical Revision No. 49 was approved on September 16, 2010. The revision allowed for <br />permanent retention of the segment of light use road (LU-3A) on land owned by the Bureau of <br />Land Management. <br />Technical Revision No. 50 was approved on October 7, 2010. The revision included new designs <br />using turf reinforcement matting for the YPM-13 post mining drainage channel. <br />Surety Release No. 2 was approved on June 15, 2010. The Division approved Phase I bond <br />release on 456.7 acres of regraded disturbed lands. This release is also referred to as a "Part 2 <br />Phase I Release" since the Division approved a Partial Phase I release on 173.02 acres on March <br />6, 2007. <br />Yoast Mine R December 15, 2010
