proposed sample adequacy testing to be in compliance with Rule 4.15.11. <br />Minor Revision No. 67 was approved by the Division on November 19, 2009 and incorporated <br />reports from vegetation studies conducted on site. <br />Minor Revision No. 68 was approved by the Division on June 24, 2010 and provided an update to the <br />weed management plan. <br />Minor Revision No. 69 was approved by the Division on October 8, 2010. The revision incorporated <br />a landowner request letter for retention of Pond 009. <br />Minor Revision No. 70 was approved by the Division on December 2, 2010. The revision revised the <br />seed bed preparation methods to be employed on steep slopes. <br />Surety Release No. 2 was approved on May 7, 2010. The Division approved Phase I bond release on <br />721.9 acres of regraded disturbed lands. <br />Please refer to the Division's previous mid-term review and renewal findings documents for a summary <br />accounting of previous revision actions. <br />The Review Process (RN-5) <br />On April 5, 2010, the Division notified Seneca Coal Company that its permit for the Seneca H-W <br />Mine would expire on December 31, 2010. On June 15, 2010, Seneca Coal Company submitted an <br />application for successive renewal of Permit C-82-057 for the Seneca II-W Mine. The application, <br />designated Permit Renewal No. 5 (RN-5), was deemed complete for purposes of filing on June 24, <br />2010, and completeness notifications were sent to Town of Hayden, Upper Yampa Water <br />Conservation District, Colorado Natural Heritage Program, Division of Water Resources, U.S. <br />Army Corps of Engineers, Office of Surface Mining, Routt County Commissioners, Routt County <br />Planning Department, BLM Little Snake Field Office, Water Quality Control Division, State Land <br />Board, NRCS Steamboat Springs Field Office, Air Pollution Control Division, Colorado Geological <br />Survey, Colorado Division of Wildlife, State Historic Preservation Office, U.S Fish and Wildlife <br />Service, and permit area landowner Theresa Friederich. A public notice of the application was <br />published in the Steamboat Pilot once a week for four consecutive weeks beginning July 11, 2010 <br />and ending August 1, 2010. There were no comments regarding this permit renewal received by the <br />Division as a result of the published public notice. <br />One comment letter was received during the review. The State Historic Preservation Officer (SHPO) <br />commented in a letter of July 14, 2010 that, because the application would not result in additional <br />land disturbance, there would be no effect on historic properties. <br />The Division reviewed the permit renewal application and found no adequacy issues or concerns <br />with the renewal of the permit. <br />Seneca II-W Findings Document 7 C1982057 <br />Permit Renewal No. 5 December 9, 2010
