DEMONSTRATION WILL INCLUDE COPIES OF SIGNED LANDOWNER REQUESTS <br />FOR ROAD RETENTION FROM EACH AFFECTED LANDOWNER. ALL ROADS OR <br />SEGMENTS OF ROADS REQUESTED FOR RETENTION WILL BE IDENTIFIED <br />CONSISTENT WITH DESIGNATION IN THE PERMIT APPLICATION (HAUL ROAD G, <br />RIDGELINE ACCESS ROAD, OIL WELL ACCESS ROAD, ETC.) THE ROAD <br />RETENTION DEMONSTRATION WILL BE SUBMITTED TO AND APPROVED BY THE <br />DIVISION PRIOR TO APPROVAL OF PHASE 1 BOND RELEASE FOR ANY <br />RECLAMATION PARCEL THAT INCLUDES A ROAD OR ROAD SEGMENT TO BE <br />RETAINED FOR THE POSTMINING LAND USE. <br />The Division recently approved TR-68, which provided landowner requests for several of the <br />proposed permanent roads subject to Stipulation 32. <br />Summary of Revisions Since the September 29, 2008 Midterm Review <br />Since the Midterm Review was conducted by the Division on September 29, 2008, Seneca Coal <br />Company has submitted nine minor and thirteen technical revisions to the permit and has received <br />approval for one Phase I bond release. <br />Technical Revisions <br />Technical Revision No. 62 was approved by the Division on June 2, 2009. The revision was <br />submitted in response to the midterm review, and included documentation to clarify the status of <br />structures proposed for permanent retention, an updated Hydrologic Monitoring Map and <br />clarification of the status of a number of wells and springs, <br />Technical Revision No. 63 was approved by the Division on March 19, 2009. The revision <br />incorporated groundwater points of compliance to comply with Rule 4.05.13. <br />Technical Revision No. 64 was approved by the Division on August 24, 2009 and discontinued <br />wildlife monitoring for big game at the site, since surface coal mining operations had ceased. <br />Technical Revision No. 65 was approved by the Division on October 29, 2009. The revision <br />discontinued annual revegetation monitoring in lieu of statistically adequate sampling in support of <br />Phase II and Phase III bond release. <br />Technical Revision No. 66 was approved by the Division on October 5, 2009. This revision included <br />geotechnical information and a stabilization plan for the Pond 016 Slide. <br />Technical Revision No. 67 was approved by the Division on October 1, 2009. The revision included <br />plans for additional watershed stabilization measures to be employed at the site. <br />Technical Revision No. 68 was approved by the Division on October 12, 2010. This revision <br />includes some of the documentation required by Stipulation 32, for permanent retention of various <br />Seneca II-W Findings Document 5 C1982057 <br />Permit Renewal No. 5 December 9, 2010
