The culvert designs in the permit depict several multiple culverts for a road crossing. <br />In all cases where the multiple culverts are used, the combined end areas are greater <br />than 35 square feet. Rule 4.03.1(4)(e)(i) requires all culverts with end areas greater <br />than 35 square feet be designed to convey flows from the 20-year-24-hour storm. The <br />applicant has complied with this regulation. <br />The applicant has proposed that certain haul road segments be retained in reduced <br />configuration for post-mining ranch roads, with other haul roads to be reclaimed to <br />AOC and revegetated. Those road segments proposed to be reduced to a 20 foot <br />travel width to replace pre-existing ranch roads include the Mine Entrance Haul Road <br />(MEHR), and segments or all of Haul Roads A, G, F, H, J, K, and L. The applicant <br />has also proposed to retain the Ridgeline Access Road, to connect Road G with <br />proposed permanent road segments in the reclaimed "A" Pit area and the South <br />Extension Area, and the Oil Well Access Road. Several light use roads are also <br />proposed for permanent retention. All currently approved permanent roads are shown <br />on Exhibit 20-2 of the permit application package. <br />Based on review of Technical Revision 42 (TR-42), the Division determined that <br />written landowner requests required by Rules 4.03. 1 (1)(f)(ii) and 4.03.2(1)(g)(ii) had <br />not been provided for various haul road and access road segments proposed for <br />permanent retention. The following stipulation (Stipulation 32) was attached to the <br />Division's approval decision for TR-42, and the stipulation remains in effect. <br />STIPULATION 32 <br />FOR PERMANENT ROAD RETENTION ON RECLAIMED LANDS, THE <br />PERMITTEE WILL SUBMIT, WITHIN A COMPLETE REVISION <br />APPLICATION, DEMONSTRATION OF COMPLIANCE WITH 4.03.1(1)(f) <br />OR 4.03.2(1)(g) AS APPLICABLE. THE DEMONSTRATION WILL INCLUDE <br />COPIES OF SIGNED LANDOWNER REQUESTS FOR ROAD RETENTION <br />FROM EACH AFFECTED LANDOWNER. ALL ROADS OR SEGMENTS OF <br />ROADS REQUESTED FOR RETENTION WILL BE IDENTIFIED <br />CONSISTENT WITH DESIGNATION IN THE PERMIT APPLICATION <br />(HAUL ROAD G, RIDGELINE ACCESS ROAD, OIL WELL ACCESS ROAD, <br />ETC.). THE ROAD RETENTION DEMONSTRATION WILL BE <br />SUBMITTED TO AND APPROVED BY THE DIVISION PRIOR TO <br />APPROVAL OF PHASE 1 BOND RELEASE FOR ANY RECLAMATION <br />PARCEL THAT INCLUDES A ROAD OR ROAD SEGMENT TO BE <br />RETAINED FOR THE POSTMINING LAND USE. <br />Seneca II-W Findings Document 20 C1982057 <br />Permit Renewal No. 5 December 9, 2010
