Pineda <br />Director <br />This item is in regards to a Notice of a Reason to Believe a Violation Exists, Cease and Desist Order, <br />Corrective Actions and Civil Penalties for a possible violation of. <br />§34-32.5-116(4)(1) C.R.S. for failure to protect areas outside of the affected land from slides or damage <br />occurring during the mining operation <br />and <br />§34-32.5-116(4)(j) C.R.S. for failure to stabilize and protect all surface areas of the affected land, <br />including spoil piles. so as to effectively control erosion. <br />CHRONOLOGY: <br />October 4, 2010: Division inspection. Possible violations observed. <br />October 22, 2010: Division sends RTB letter scheduling the matter for hearing before Mined land <br />Reclamation Board for 17-18 November 2010. <br />November 17, 2010: Operator agrees to Consent Agenda.
