Additional information has also been <br />added to the Reclamation Plan section including demolition and disposal <br />location for all debris. <br />In the narrative in Exhibit 37, Page 4 of the submittal, New Elk states that <br />they will use the existing Jansen railroad building for an office. Pursuant to <br />Rule 2.05.3(3)(b), please provide a location, description, plans and <br />construction dates of this structure. Please specify in the text whether <br />Jansen railroad building will remain as a permanent structure following <br />demolition and reclamation of the other loadout structures. If the <br />structure will remain as permanent, New Elk will need a letter from the <br />owner of the structure as well as the landowner requesting its retention <br />as a permanent facility. <br />Response: Additional information for the Jansen railroad building has been <br />provided in the Operations Plan section of the revised application. The <br />building will be retained as a permanent structure and a letter from the <br />landowner is included as Attachment 2 of the application. <br />4. In the narrative in Exhibit 37, Page 4 of the submittal and on Figure 2 New <br />Elk states that there will be a conveyor and a new rail system constructed at <br />the loadout. Pursuant to Rule 2.05.3(3)(c), please provide a detailed <br />description of the conveyor and rail system at the loadout, including the <br />dimensions of these systems. Please include detailed reclamation <br />information for these systems, including the proposed location of the <br />demolition debris. <br />Response: Detailed descriptions of the conveyor and new rail system have <br />been provided in the revised application in the Operations Plan section listing <br />the dimensions and foundation and footer information. Additional <br />information has also been added to the Reclamation Plan section including <br />demolition and disposal location for all debris. <br />5. In the narrative in Exhibit 37, Page 4 of the submittal New Elk states that the <br />coal will be trucked into the site and dumped into a hopper. There was no <br />description of the proposed haul road given. Pursuant to Rule 2.05.3(3)(c), <br />please provide a detailed description of any proposed haul road at the <br />loadout.
