A flood plan analysis is part of the existing Hogue River Pit file; it is hereby incorporated <br />by reference. <br />(b) Identify all known aquifers: <br />The only known aquifer is the alluvial aquifer into which the Operation will mine. <br />A review of the domestic and irrigation well applications filed with the Office of <br />the State Engineer (SEO) into this alluvial aquifer states, water rights were filed <br />on all unnamed aquifers. It is believed all wells within and adjacent to the <br />proposed expansion area were completed in the alluvial aquifer above bedrock. <br />The bedrock barrier will be the floor of the proposed pond. No aquifers <br />immediately below bedrock should be affected by the proposed mining or <br />reclamation operations. <br />(c) Provide a plan showing how water from de-watering operations or <br />from runoff from disturbed areas, stockpiles, and operating surfaces will be <br />managed to protect against pollution of surface and ground water, both <br />during and after operations: <br />The Operation will need to dewater the existing and the expansion areas <br />continuously during active mining and reclamation operations. (The Operator may <br />allow the pit to fill with water during extended periods of inactivity, such as <br />during winter months.) The operation will continue to be dry mined. The existing <br />Hogue River Pit pumps water for discharge into the existing waste water <br />treatment pond to remove sediment. The Operator holds a current waste water <br />discharge permit with the Water Quality Control Division, Colorado Department <br />of Public Health and Environment. The Operation is in compliance with this <br />permit at the time of submittal of this amendment application. <br />The Operation also holds a Stormwater Discharge Permit. During mining, storm <br />water runoff will drain to the open pit mining area. Disturbed areas surrounding <br />mining operation have been stabilized with perennial vegetation. The new topsoil <br />berms along the north and a portion of the west sides of the expansion area will be <br />shaped, seeded and mulched for stability and erosion control in conformance with <br />NRCS recommendations. In addition, every reasonable effort will be made to <br />limit or prevent discharges of storm water from the site. If required, the Operator <br />will revise and implement its Hogue River Pit, site-specific, Stormwater <br />Management Plan and a Spill Prevention, Control and Countermeasure Plan <br />(SPCC). <br /> <br />Page 30
