3.1.6 Water-General Requirements: <br />• (1) Hydrology and Water Quality: <br />Ground water is discussed in Exhibit "G" - Ground Water Information. <br />As proposed, the mining and reclamation plans will not adversely affect <br />surface water hydrology or surface and ground water quality. As <br />discussed, the Operator will implement its Spill Prevention, Containment <br />and Countermeasures Plan and Stormwater Management Plan and has a <br />Stormwater Discharge Permit for the current Hogue River Pit. <br />(a) Compliance with applicable Colorado water laws and <br />regulations governing injury to water rights: <br />Operator will comply with Colorado water laws and regulations <br />governing injury to existing water rights. Water rights utilized for <br />the amended Hogue River Pit will be those held by HRLP. <br />(b) Compliance with applicable federal and Colorado water <br />quality laws and regulations, including statewide water quality <br />standards and site-specific classifications and standards <br />adopted by the Water Quality Control Commission: <br />• The Operator will comply with applicable Federal and Colorado <br />water quality laws and regulations, including all the standards <br />adopted by the State Water Quality Control Commission. (Please <br />see items 3.1.5 (10), and (11) above.) <br />The Operator currently holds a Waste Water Discharge Permit <br />with the Water Quality Control Division, Colorado Department of <br />Public Health and Environment, Permit Number COG-500243. <br />The Operator, at the time of this permit amendment application, is <br />in compliance with the terms and conditions of its Waste Water <br />Discharge Permit. This permit will continue to be needed for the <br />expansion operations. <br />(c) Compliance with applicable federal and Colorado <br />dredge and fill requirements: <br />The Operator will comply with all applicable federal and Colorado <br />dredge and fill regulatory requirements. Where necessary, a Corp <br />of Engineers 404 permit will be obtained prior to any dredging or <br />filling of wetlands. At this time the Operator is not aware of any <br />• wetlands that could be affected by the proposed operation. The <br />Page 18
