Ms. Kris Pennington <br />Page 4 <br />December 8, 2010 <br />The response to this clarification should consider the Item 7 under Exhibit C above regarding <br />the unnamed drainage. <br />3. Rule 6.4.4(f)(ii) requires a description of "nature of the stratum immediately beneath the <br />material to be mined in sedimentary deposits." Provide a narrative of the material underlying <br />the 8 to 14 feet of the deposit to be extracted. <br />4. Mining plan maps (Exhibit D(f)): refer to the Item 4 under Exhibit C above with respect to <br />boundary line lengths. <br />5. Please provide approximate or proposed locations for the segregated topsoil and overburden <br />stockpiles. <br />6. The "suitable cover crop" for protecting soil stockpiles that remain undisturbed for more than <br />12 months should avoid introduced species. <br />7. The mine is relatively remotely located. Will any fuel or other petroleum products be stored <br />on site? If so, spill containment and reporting should be appropriate for the volume(s) of <br />product(s) to be stored. <br />8. During the November 8th Pre-Operation Inspection a large stockpile of concrete rubble was <br />observed on site. The proposed mine plan does not mention importing any material. Please <br />indicate the purpose/use of this material and note that Logan County must notify the Division <br />per Rule 3.1.5(9). <br />6.4.5 EXHIBIT E - Reclamation Plan <br />1. Final grading is briefly discussed in Exhibit D and the first paragraph of Exhibit E. Both <br />indicate the resulting pit will be "sloped to the original grade using stockpiled overburden". <br />If the deposit to be mined is an average of 10 feet thick and is mined out, an additional 10- <br />foot layer of overburden material will be required to replace the extracted material and return <br />the land to the original grade. Please discuss in detail and clarify the final grading intent in <br />Exhibit E„ Based on the topography provided in Exhibit F - Reclamation Plan Map, the <br />steepest undisturbed existing slope is approximately 8:1 (horizontal to vertical). Other <br />existing slopes in the proposed expansion area appear to be much flatter. The proposed 3:1 <br />maximum slope is considerably steeper than the existing topography <br />2. Explain why there will be no off-site drainage as indicated in the last sentence of the last <br />paragraph of Exhibit E. <br />3. The proposed premium mixture of introduced cool-season grasses for the intended rangeland <br />use reclamation is inappropriate. Rangeland reclamation should include native species such <br />as those listed in Exhibit J. The Natural Resource Conservation Service (MRCS) can provide <br />a recommendation for an appropriate seed mix. <br />4. Please describe how weeds will be mitigated and controlled during mining and reclamation <br />of the mine site to ensure proper vegetation establishment. <br />5. The reclamation plan indicates after a 3-5 acre area is mined, the slopes will be regraded. <br />Regrading is typically the first step in the reclamation process. According to Rule 3.1.3, <br />reclamation must be complete within five years after it began. With this in mind, please <br />provide a schedule when reclamation of the site will begin and end, including topsoil
