I spoke with Gary Marin, president of the Miff and Platte Valley Ditch Company, about the <br />proposed amendment and the possibility it may have some impact on their irrigation ditch. <br />Attached is a letter from Gary Marin. They are not opposed to the amendment as proposed, even <br />though one area does come closer than 200 feet of their ditch. The letter indicates there will be <br />no significant impact on the irrigation ditch. <br />The proposed final contours have been modified. <br />6.3.6 EXHIBIT G - Source of Legal Right-to-Enter <br />The copy of the property deed to Kristine Couch referred to in the package was not found. <br />The Division will also need to receive the notarized access agreement between property <br />owner and permittee before the amendment can be approved. <br />The deed showing Kristine Couch as landowner is attached. A notarized statement from Kristine <br />is also attached, giving permission for her father to expand the pit. <br />6.3.12 EXHIBIT L - Permanent Man-Made Structures <br />If the modified permit boundary remains within 200 feet of the ditches immediately south <br />of the permit area, a damage waiver agreement with the ditch owners will be needed. If the <br />permit boundary is modified to stay more than 200 feet from the ditches the waiver is not <br />necessary. <br />The letter from Gary Marin provides a damage waiver as required by the Division. <br />This concludes our responses to your adequacy review.
