<br />Pit. Figures 3 and 4 show the required mitigation work to be completed at the pit. <br />Performance Standards for the mitigation are listed in Section 2.8 of the Final Plan <br />and include at least 80 percent coverage of wetland plants along with 6 other <br />standards. <br />Request for Release of Land <br />Skanska is requesting that the 12.4 acres of land which are required for mitigation <br />under the Section 404 permit by the District be released from the 112 Mine Permit, <br />and that the bond money associated with this land be returned to Skanska. Figure 1 in <br />Attachment C shows the new, proposed mine permit limits. <br />All other terms and conditions of the 112 Permit will remain unchanged and in effect. <br />The ultimate condition of the land included in the mitigation area (Figure 1 in <br />Attachment C) is subject to the terms and conditions of the Section 404 permit held <br />by the District (Attachment A) and the Final Mitigation Plan (Attachment B). The <br />District must monitor the success of the mitigation site and submit plans annually to <br />the U.S. Army Corps of Engineers (Corps). The Corps has the authority to enforce <br />the mitigation plan to ensure functioning wetlands are created as required by the <br />Section 404 permit. <br />The 12.4 acres of land to be released will continue to be owned by the Greer Family <br />Trust however the District will purchase a conservation easement on the land and will <br />be the responsible party for completion of the mitigation for the 404 Permit. <br />We appreciate you assistance with this matter and are available to provide additional <br />information, as needed. <br />Sincerely, <br /> <br />Craig Wickstrom, PE <br />Engineer <br />Skanska USA Civil West <br />Rocky Mountain District, Inc.
