This letter is being sent <br />as you recommended during the conversation with Dave Mehan of Bikis Water <br />Consultants LLC (BWC) on October 28, 2010. <br />Background <br />Skanska received a 112 State Mine Permit for the Red Mesa Pit on November 30th. <br />2009. The reclamation plan this permit requires that disturbed areas be adequately <br />reclaimed to upland condition, as specified in the plan. Skanska has achieved the <br />reclamation standards on most of the area addressed in this release request. <br />The land at the Red Mesa Pit is owned by Mr. Pat Greer at 8097 CR 100, Marvel <br />Colorado, telephone (970) 588-3325. Mr. Greer entered into an agreement with the <br />La Plata Water Conservancy District (District) to allow for a portion of the Red Mesa <br />Pit to be used as mitigation for the District's Long Hollow Reservoir Project. <br />Skanska was not aware of the agreement between Mr. Greer and the District. This <br />agreement calls for the creation of 3.85 acres of wetlands to the east of the existing <br />pond at the Red Mesa Site. <br />The Section 404 permit that was issued to the District for Long Hollow Reservoir <br />requires the creation of 3.85 acres of wetlands at the Red Mesa Pit (See a copy of the <br />Section 404 permit in Attachment A). Furthermore, Special Condition No. 3 of the <br />404 Permit calls for submittal of a Final Mitigation Plan 60 days prior to <br />commencement of the work, and Special Condition No.6 requires the mitigation to be <br />completed concurrently or in advance of the start of construction on the reservoir. <br />A copy of the Final Mitigation Plan (August 2010) is included as Attachment B. <br />Figure 1 of this plan shows the location of the proposed mitigation at the Red Mesa
