The revised Exhibit D states the proposed post mine land use will be to restore the property back to <br />its current "Mining District Zoning designations, resembling semi-arid rangeland". Exhibit D was not <br />revised to indicate the post mine land use of the site to be rangeland as outlined in item #9n of the <br />second adequacy review. Please revise. <br />5.) Exhibit D indicates the.632 acre mobile mill site area will not be graded or revegetated. The <br />response to item #9n of the second adequacy review indicated Venture Resources understood the site <br />must be reclaimed to meet the post mine land use of rangeland. Leaving this area un-vegetated will not <br />reclaim the site to rangeland and will make the area prone to noxious weed infestations and erosion. <br />Please submit a plan for grading and re-vegetation of the mobile mill site area and update the <br />Reclamation Cost Schedule to include a cost for this activity. <br />Conditional Approval: <br />Based on the review of the technical revision submitted on November 12, and the response to the <br />second adequacy review, if the adequacy review issues above are addressed to the Division's <br />satisfaction, the Division would be in a position to approve the permit application for limited processing <br />and tailings impoundment. This approval will allow Venture Resources to buildout through Bench #2 <br />incorporating the geogrid and French drain designs. Prior to proceeding to construct Bench #3 through <br />Bench #5, Venture Resources must demonstrate to the Division's satisfaction the impoundment will <br />meet our minimum safety factors for the entire buildout through Bench #5. <br />Please remember the decision date for the application is November 24th, 2010. Given this date is 365 <br />days from the date the application was considered filed with the Division, if outstanding adequacy <br />review issues remain for the application after this date, the Division will set the matter for a Board <br />hearing. At the hearing the Board may at the request of the applicant extend the review time and <br />decision date, deny the application, or approve the application with or without conditions.
