Pineda <br />Director <br />The Division of Reclamation, Mining and Safety received your full response to the second adequacy <br />review on November 22, 2010. There are several issues that must be addressed prior to the Division's <br />approval of the application. The decision date for this application is November 24t", 2010. Please <br />address the following concerns: <br />1.) Page 5, Item #9g of the second adequacy review indicated Venture Resources is to notify the Division <br />in advance of tailings sample collections so the activity can be inspected. Please commit to notifying the <br />Division 10 days prior to tailings sample collections. If the Shelby tube samples are found to be un- <br />representative of undisturbed tailings, DRMS will require cone penetrometer or other direct testing be <br />done. <br />2.) The Division disagrees with Venture Resources response to item #9d in the response letter. <br />Imported material will likely not meet the definition of "Inert Material" as defined by Rule 1.1(24). <br />After processing, the tailings of this imported material should be inert and will be used as structural fill <br />to create the tailings impoundment. Some of the requirements of the structural fill notice described in <br />Rule 3.1.5 (9) are described in the mining plan; however, as stated in the Rule, the Division is not limited <br />to just those requirements specified. The Division will require a notice prior to importation of material <br />into the site indicating a general description of the material to be imported, location information and <br />DRMS permit number for the source of the material, the volume of material to be imported, the <br />approximate dates the importation will commence and end, however, such dates shall not be an <br />enforceable condition. The Division will process the notice(s) to be submitted in accordance with Rule <br />3.1.5(9). <br />3.) The revised Exhibit C submitted with the Technical Revision received by the Division on November <br />12, provides a sampling procedure to measure saturation levels using piezometer standpipes. This will <br />measure saturation of the tailings and the phreatic surface location. Proper dewatering of the tailings <br />and the location of the phreatic surface will have a substantial impact on the stability of the <br />impoundment. Venture Resources committed to conducting monitoring of these piezometers once <br />every quarter and plotting the results on a graphic map schematic of the tailings impoundment.
