<br />excavation is projected to range from 5 to 10 feet deep. At this point, it appears the excavation <br />will daylight to the south and grading will need to occur on the pit slopes to north. <br />Based on the current operation, the proposed two phase mining/reclamation plan and the actual <br />topography at the site, the basin depicted on the reclamation plan map does not adequately <br />portray the direction and rate of slope of all the reclaimed land. Please update the reclamation <br />plan map with contour lines of sufficient detail to portray the direction and rate of slope of the <br />reclaimed land. Or, submit cross section drawings to illustrate the expected physical appearance <br />of the affected land after reclamation is complete. <br />6.4.7 EXHIBIT G - Water Information <br />22.) As discussed in the review of the mining plan, please indicate how the intermittent stream <br />located in the northwest corner of the site will be mined and reclaimed to maintain the area's <br />natural water course, and to prevent erosion and sedimentation offsite. The applicant may want <br />to consider maintaining a setback from the stream, and not disturb this area. If this option is <br />chosen, the Operator should construct a berm or install erosion control structures such as straw <br />bales or silt fence between the mining area and the drainage in order to prevent sediment runoff <br />due to the mining operation from entering the intermittent stream. <br />6.4.9 EXHIBIT I - Soils Information <br />23.) Two soil units are located in this area, the BaC (Baca Clay Loam) and Tr (Travessilla Stony <br />Sandy Loam). The map indicates the soil distribution over the area, however the profile of the <br />soil which indicates the thickness of the various soil horizons are not given in the exhibit. Please <br />indicate the thickness of the horizons for both soil units. <br />6.4.12 EXHIBIT L - Reclamation Costs <br />24.) The reclamation cost estimate supplied for this exhibit does not include a cost for vertical <br />highwall reduction. Based on the Divisions observations at the site during previous site <br />inspections, the Operator creates small bench steps from the mined sandstone resulting in <br />multiple small vertical stone faces. Based on your answers to the questions for the Reclamation <br />Plan exhibit, please provide an estimate for the cost to reclaim these small bench steps to a 3:1 <br />horizontal to vertical ratio. <br />25.) The Division estimates it will take approximately 8,066 cubic yards of overburden to spread <br />4 inches of this material over 15 acres. The estimate supplied with the application indicates only <br />5000 yards will be replaced. Please clarify and update the submitted estimate. <br />26.) The Division estimates it will take approximately 12,100 cubic yards of topsoil to spread 6 <br />inches of this material over 15 acres. The estimate supplied with the application indicates only <br />8000 yards will be replaced. Please clarify and update the submitted estimate. <br />6.4.14 EXHIBIT N - Source of Legal Right to Enter <br />27.) The source of legal right to enter must consist of one of the following documents; an access <br />lease, deed, abstract/title, current tax receipt or a signed statement by you (landowner) and <br />acknowledged by a notary public stating that you have legal right to enter and mine the site. <br />Please submit one of these items listed above. <br />4
