PERMIT #: M-1983-187 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: November 8, 2010 <br />OBSERVATIONS <br />This was a requisite Pre-Operation inspection as a result of a request to amend the current permit to expand the Kues <br />Gravel Pit, DRMS File No. M-1983-187 operated by Logan County. This site is located approximately six miles west of <br />Fleming, Colorado in Logan County (approximately '/2 mile north of US Highway 6 on county Road 67). 1, Tim Cazier <br />and Eric Scott of the Colorado Division of Reclamation, Mining and Safety (Division) conducted the inspection. A dozer <br />operator was on site and offered an overview of current operations and how the proposed expansion is marked. <br />Logan County has requested an expansion of 30.19 acres from the existing 50.46 permitted acres to 80.65 acres. The post <br />mine land use for existing and expansion permit area is rangeland. <br />Backfilling and Grading: <br />Aconcrete rubble stockpile was observed within the permit area (Figure 2). Please clarify intended use of concrete, <br />whether for recycling, inert fill, etc. The use of inert fill will require the operator notify the Division per Rule 3.1.5(9) (a) <br />_(f)Some furniture was observed on the west side of the currently permitted area (Figure 3). All refuse should be properly <br />disposed of offsite (Rule 3.1.5(5)). <br />The following observations were noted during the inspection: <br />Hydrologic Balance / Storm Water MGT Plan: <br />The dozer operator said he was filling in the depression area in the middle of the operating area (Figure 1). He thought <br />that there could have been as much as five feet of water impounded in the area he was working earlier in the summer. <br />Although no ponded water was visible during the inspection, the operator said there were a lot of areas that would not <br />support the weight of the dozer. Dried mud was observed to completely fill the vertical space between the upper and <br />lower track of the dozer. This suggests water is ponding for longer than 72 hours. There is potential for a similar <br />problem in the southwest corner of the proposed expansion area, depending on excavation depths and grading. Run-on <br />control and proper grading practice should be used to prevent the retention of storm water on-site for more than 72 hours. <br />Rule 3.1.6(1) and 6.3.3(1). A SWMP may be required from CDPHE. <br />General Compliance With Mine Plan: <br />The existing mine plan states only three to five acres will be mined at one time. The current mining operation has <br />disturbed roughly 15 to 20 acres. Only a few acres are currently being reclaimed (Figure 5). <br />Other Concerns: <br />The permit amendment application indicates the power-line next to County Road 67 is outside the proposed permit <br />boundary. Assuming the orange lath staking accurately represents the proposed permit boundary, all power poles are <br />inside the proposed permit boundary. The southern-most power pole is 30 to 40 feet inside the proposed boundary <br />(Figure 4). <br />All of these issues may also be resolved by making the appropriate modifications to the permit amendment mining plan <br />submitted in response to the adequacy review process under a separate cover letter. <br />Page 2 of 4
