• <br />Page 90 <br />Section 2.04. 11 <br />(a) Published data and other information; <br />(b) Site - specific information obtained by the applicant; and <br />(c) Written guidance obtained from agencies consulted. <br />(4) The potential for impacts to rare and endangered animal species shall be <br />evaluated by the Division in consultation with appropriate Federal and <br />State agencies. <br />2.04.12 Prime Farmland Investigation. <br />110(2)(q) <br />111(1)(b)(II) <br />(1) For areas where mining was not authorized under permits issued or <br />mining plans approved prior to August 3, 1977, the applicant shall <br />conduct a preapplication investigation of the proposed permit area, or, <br />in the case of underground mining, only those areas proposed to be <br />disturbed by surface operations or facilities, to determine whether lands <br />within the area may be prime farmland. The Division, following <br />consultation with the U.S. Soil Conservation Service, shall determine <br />the nature and extent of the required prime farmland investigation. <br />(2) Land shall not be considered prime farmland where the applicant can <br />demonstrate one of the following: <br />aC�The land has not been historically used as cropland; <br />The slope of the land is 6 <br />D The land is not irrigated or naturally subirrigated, has <br />developed irrigation water supply that is dependable or of adequate <br />quality; <br />A very rocky surface exists, or the land is frequently flooded <br />during the growing season, more often than once in 2 years, and <br />the flooding has reduced crop yields; <br />1) The growing season is less than 90 days; <br />(f) On the basis of a soil survey of lands within the permit area, there <br />are no soil map units that have been designated prime farmland by <br />the U.S. Soil Conservation Service; or <br />�J <br />
