Page 287 <br />Section 4.05.18 <br />(b) That during and after mining, the water quantity and quality, and <br />other environmental resources of the stream shall not be adversely <br />affected; and <br />(c) If there will be a temporary or permanent stream - channel <br />diversion, the diversion will comply with 4.05.3 and 4.05.4. <br />(2) The area not to be disturbed shall be designated a stream buffer zone <br />and marked as specified in 4.02. <br />4.06 TOPSOI <br />4.06.1 General Requirements. <br />120(2)(e) (1) Before disturbance of areas affected by surface coal mining operations, <br />121(2)0) topsoil and subsoils to be saved under 4.06.2 shall be separately <br />removed and segregated from other material. <br />• (2) After removal, topsoil shall be immediately redistributed in accordance <br />with 4.06.4, or stockpiled pending redistribution in accordance with <br />4.06.3. <br />4.06.2 Removal. <br />(1) Timing. Topsoil shall be removed from areas to be affected by surface <br />coal mining operations after vegetation cover that would interfere with <br />the use of the topsoil is cleared but before any drilling, blasting, <br />mining, or any other surface disturbance. Vegetation cover shall be <br />cleared only from areas to be affected, to the extent necessary to <br />minimize the removal of topsoil along with large vegetation material. <br />Vegetation cover may not be required to be cleared upon demonstration <br />to and approval by the Division that such vegetation cover is necessary <br />or desirable to ensure soil productivity consistent with the postmining <br />land use. <br />(2) (a) Materials to be removed. Topsoil, as determined in 4.06.2.(2)(b), <br />shall be removed in a separate layer from the areas to be <br />disturbed, unless the use of substitute or supplemental materials is <br />approved by the Division in accordance with 4.06.2(4). A <br />variance from topsoil removal may be granted by the Division for <br />good cause shown. Areas which may qualify for a variance are: <br />
