May Day and Idaho Mine Complex 112 (d) Permit Application <br />(3) No alternative plan for identifying the boundaries of the affected land is needed. <br />• Rule 3.1.13 Spill Reporting <br />The Office will be notified of a spill of any toxic or hazardous substance, including spills of pe- <br />troleum products (gasoline, engine oil, etc.), that occurs within the mined land permit area or area <br />encompassed by a Notice of Intent and which would be required to be reported to any Division of <br />the Colorado Department of Public Health and the Environment, the National Response Center, <br />the Colorado Emergency Planning Commission, any local Emergency Planning Commission, lo- <br />cal Emergency Planning Committee, or the State Oil Inspector (Exhibit T - DMO EPP, Section <br />6.4.20(7)(e)). <br />(1) The Office will receive notification within 24 hours of the time the spill is reported to any <br />other agency with jurisdiction over the spill, notify any DRMS Minerals Program Field Of- <br />fice or the Minerals Program Denver Office, Division of Reclamation, Mining and Safety, via <br />phone, facsimile, or email; <br />(2) Included in the notice will be any relevant information known at the time contact is made with <br />the Office that would assist the Office in assessing spill seriousness, such as: <br />(a) operation name, DRMS permit number and name of person reporting the spill, <br />(b) telephone number of a responsible company official for the Office staff to use as a con- <br />tact, <br />(c) date and time of spill, <br />(d) type of material spilled (CAS number if applicable, from the material safety data sheet <br />(MSDS) form), <br />(e) estimate of the amount spilled, whether any material has left the permit area, and where <br />the spilled material went, and <br />(f) initial measures taken to contain and clean up spill. <br />(3) The Office will be copied on any correspondence and/or written reports provided to other <br />agencies. Those reports will include, if necessary, the information outlined in Rule 3.1.13(2). <br />(4) It is understood that for permits approved prior to the effective date of these rules, the re- <br />quirements of Rule 3.13 shall super cede stipulations to permits regarding spill reporting. <br />6 4 5(2) (d) Topsoil Mine Rock and Reveaetation <br />The surface of disturbed areas will be reclaimed and to the extent possible scarified, amended (if needed), <br />seeded, and planted. <br />Topsoil Segregation, Preservation, and Replacement <br />Soil salvaging and stockpiling will not be undertaken for the following reasons (Exhibit I): <br />o collection of thin topsoil on the steep slopes will be difficult and unsuccessful; <br />o topsoil thickness in the affected areas is less than six inches; <br />o limited area to store stockpiled topsoil; and <br />o natural regeneration on disturbed areas indicates that topsoil is not required for reclamation. <br />May Day Idaho Mine Complex I I2(d) Permit Application <br />September 21, 2010 (REVISED Oct. 22, 2010) <br />15
