Page 35 <br />Section 1.04 <br />sited structures, facilities, or other property or materials on the <br />surface, resulting from or incident to such activities. <br />103(25) (133) "Surface coal mining and reclamation operations" means surface coal <br />mining operations and all activities necessary and incident to the <br />reclamation of such operations. <br />(134) "S ter" means water that is either flowing or standing on the <br />surface of the earth. <br />(135) "Suspended solids or nonfilterable residue" (expressed as milligrams per <br />liter), means organic or inorganic materials carried or held in <br />suspension in water which are retained by a standard glass fiber filter in <br />the procedure outlined by the Environmental Protection Agency's <br />regulations for waste water and analyses (40 CFR 136). <br />(135a) "Tangible net worth" means net worth minus intangibles such as <br />goodwill and rights to patents or royalties. <br />103(27) (136) echnical revision means a minor change, including incidental permit <br />• boundary revisions, to the terms or requirements of a permit issued <br />( under these Rules, which change shall not cause a significant alteration <br />in the operator's reclamation plan. The term includes, but is not limited <br />to, increases in coal production, reduction or termination of approved <br />environmental monitoring programs, or design changes for regulated <br />structures or facilities. <br />(137) "Temporary diversion" means a diversion of a stream or overland flow <br />which is used during coal exploration or surface coal mining and <br />reclamation operations and not approved by the Division to remain after <br />reclamation as part of the approved postmining land use. <br />(137a) "Temporary impoundment" means an impoundment used during surface <br />coal mining and reclamation operations, but not approved by the <br />Division to remain as part of the approved post - mining land use. <br />(138) "Ton" means 2000 pounds avoirdupois (.90718 metric ton). <br />(139) "Toxic- forming materials" means earth materials or wastes which, if <br />acted upon by air, water, weathering, or microbiological processes, are <br />likely to produce chemical or physical conditions in soils or water that <br />are detrimental to biota or uses of water. <br />
