• <br />Page II of 19 <br />Lloyd Property <br />1. Lloyd family has 24 shares of CCC water dedicated to their land. <br />2. Even though Lloyd did not actively manage their land to a high <br />level of Irrigated Pasture (IP) production, the Division of <br />Reclamation, Mining and Safety feels the landowner has the <br />right to decide if they want IP or not, in this case. So the 24 <br />shares of water will be used in a "flood irrigation" setting with <br />corrugate pipe and furrow strips. An approximate ratio of 1.67 <br />share of water per acre of irrigated grass will be used (15 acres, <br />more or less). The same ratio as what WFC will apply to the IP <br />reference area. <br />3. The plot for Irrigated Pasture will have the same mixed topsoil as <br />the rest of the land north of BB Road. However, the land will be <br />rock picked, leveled and land planed. An irrigation pipeline with <br />a valve and metering device will be run to the edge of the field <br />4. The remaining reclaimed land found on the Lloyd property will <br />receive a mixed topsoil, but the surface will not be rock picked. <br />The litter will be left on the surface to assist in erosion control <br />plus shrubs and grasses tend to do better in a more rocky <br />environment. The Post Mine Vegetation and Land Use will be <br />Dryland Pasture. <br />5. Correspondence with the Lloyd family will be made during the <br />Permit Renewal process to verify they truly want IP or would <br />they be content with an Improved Pasture (Imp-P) Post Mine <br />Land use. <br />WFC Property <br />1. There was only 12 shares of CCC water that came with the <br />purchase of this land. WFC does not wish to have this land <br />returned to an Irrigated Pasture Land Use since WFC intends to <br />WFC Exhibit 9 <br />Page 11 of 19
