Pineda <br />TO: Kent Gorham D <br />FROM: Jim Stark CZ?? <br />SUBJECT: New Elk Mine Permit Revision 03 <br />DATE: E November 2010 <br />Per your request I have reviewed the information submitted by the New Elk Coal <br />Company, LLC for Permit Revision 03 for the New Elk Mine. The permit revision is for <br />a new loadout facility in Jantzen. Specifically, you asked me to review the reclamation <br />cost estimate for the loadout facility. New Elk has provided minimal information for the <br />loadout facility and a five line reclamation cost estimate. The following are my adequacy <br />questions for PR-03. <br />Rule 2.05.3 - Operations Plan <br />New Elk has not provided any detailed information regarding the proposed coal <br />hopper, conveyor transfer points or loadout bin. Pursuant to Rule 2.05.3(3)(a) <br />New Elk must provide "(a) description, plans and drawings, describing the <br />location, construction, modification, use, maintenance and removal of mine <br />support facilities... including all buildings, structures, utility corridors and other <br />support facilities...". Please provide detailed information regarding the <br />proposed facilities at the Jantzen loadout for all structures planned. Please <br />include building dimensions and foundation and footer information. Please <br />include detailed reclamation information, including the proposed disposal <br />location of the demolition debris. <br />2. In the narrative in Exhibit 37, Page 4 of the submittal, New Elk states that they <br />will use the existing Jantzen railroad building for an office. Pursuant to Rule <br />2.05.3(3)(b), please provide a location, description, plans and construction <br />dates of this structure. Please specify in the text whether Jantzen railroad <br />building will remain as a permanent structure following demolition and <br />reclamation of the other loadout structures. If the structure will remain as <br />permanent, New Elk will need a letter from the owner of the structure as well <br />as the landowner requesting its retention as a permanent facility. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
