FAx l
Division of Reclamation, Mining, and Safety
1313 Sherman Stireet, Room 21.5
Denver, Colorado 80203
Re: New Horizon North Permit Application
Dear Division, Reclamation, Mining, and. Safety.

We are objecting to the New Permit applic4ion in the paper by Western Fuels.
'Zb is public notice is not accurate as well a? being incomplete. nie first two publications are
wrong and therefore are not considered legal publications per the requirements of the Rules and
Regulations governing public notices. We are also objecting to the permit application because
again, the Division is allowing the misclassification of the properties from irrigated. to dryland.
They are again allowing Western Fuels to dry up ands two years in advance and allowing the
water to be removed from the properties and. turning them into dryland. Another piece of
property that is listed also has been miscl.assified.
The Colorado Regulatory States that the land uses are prior to the leasing or purchasing of the
properties and that they must be returned to as good as or better than they were. The Montrose
County landuse applications all state that they will be returned to the agricultural uses that they
were prior to mining. This does not include turning all of these properties into dryland.
Thank you for your time,
Jo en Turner
Michael Morgan
