10
TO nM MEMBERS OF THE BOARD
?c
`c` /P
10. ? O
Of ry'l0/0
n9anasd f dfo
ey n
This is a signature page that acknowledges all the, contents within this notebook. The contents of
this notebook is a formal objection to the approval of Permit Revision number 6(PR-06).
As per letters received, most letters of objection were refused because DR .S did not feel that
they were specific enough, therefore this is most of the specifics covered within the
approximately 2300 page (PR-06) permit revision. All persons signing this formal objection are
well aware of the contents of this notebook and have read or seen it's documentation.
Although, according to all public notices, "persons with an interest that may be adversely
affected by the proposed decision may request a forr aW hearing before the Mined Land
Reclamation Board on the proposed decision. Such request must be made within 30 days of the
initial publication of this notice, must be in writing, and must state with reasonable specificity the
reasons for the request and the objections to the proposed decision."
Spoe ftc$that cover the entire Permit for a farmer are:
(1) Pttt the property back as good as or better than it was
(2) If it was itxigated prior to the mine leasing, not entering, the property, put it back as irrigated
(3) As the permit states, "ALL TOPSOIL, WILL BE SALVAGED", put all the topsoil back and
this is for all types of farms, not just the prime farmland. Ordered in 1993.
(4) Put the property back so that the contour of the laud is comparable to what it was before the
mine entered it and so that it can be irrigated as it was. Bud Bensons property is 27 feet higher in
elevation and the Morgans is already 7 feet higher,
(5) Put the property back so that everything that was grown prior to the mine leasing, buying, or
optioning the properties can still be grown.
(6) Put the properties back in a timely manner so that the farmers can go on being farmers and go
on, with our lives. We are all farmers and have done this our entire lives and our knowledge
should be very valuable and should be, trusted as to we know what we are doing and have made a
living doing it. It should not be up to Western Fuels who are not farmaers or the Division as to
how we farm and have farmed.. The Farmers is the One with the knowledge and the experience
and the data that the fasters provides should be used. Even NRCS has said many times, ask the
farmer, he knows, none of the rest of us are fanners. NRCS can provide data and technical.
support, but the farmers are the farmers and ask them for the experience, what they grow, bow
they irrigate, what amounts of water. and the history of the place, etc.
(7) Any major changes made to a landowners property is not done without written consent of the
landowner as per, the Colorado Regulatory Program Rules and Regulations state. Always involve
the landowner in the decisions that may adversely affect the land owner or property of the
landowner and communicate with the landowner. This has never been dope. If a question, is
asked, the mine just tells all, of us that the State requires this or that the State is making us do
