Part (e) of the <br />inert fill notice states the backfilled lake will create a level surface suitable for <br />agriculture, and the Operator committed to capping the inert backfill with two <br />feet of overburden of which, six inches of this material was designated as soil. <br />Thus, the Operator should have saved enough overburden and growth medium <br />on the site to fulfill their commitment. The Division will not approve the request <br />to leave areas 1 and 3; as delineated on the submitted reclamation plan map, un- <br />topsoiled and not revegetated. <br />Areas 1 and 3 were measured to be about 34 acres total. These areas will need <br />to be capped with an appropriate amount of overburden and growth medium to <br />establish vegetation. Please submit a revised map indicating these areas will be <br />re-soiled and revegetated. <br />As of now, the Operator is required to cap the remaining 34 acres with two feet <br />of material as described above (18 inches of overburden and 6 inches of topsoil). <br />Varra Companies, Inc. correspondence to the Colorado Office of Mined Land Reclamation (Office) in reply to 1 <br />Office correspondence of 29 July 2010 - Dakolios Pit - M-1984-036.
