To the Board Members O <br />Division of Reclamation, Mining, and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />October 23, 2010 <br /> <br />Dear Members of the Board: We are objecting to the approval of PR-06 which greatly affects us <br />and our property. I am blind and cannot see, read, nor write. Although, we have been instructed <br />that we are not allowed to object. After discussions with attorneys, if what they are asking us not <br />to object to violates any laws then the contract is not legal, at least that statement. <br />The Rules and Regulations governing surface coal mining allows any person to object. PR-06 <br />violates rules and regulations that were designed to protect the land and the landowner. <br />Irreparable damages have been done to our property and to us. We cannot accept PR-06 and ask <br />that it be withdrawn and a proper Permit Revision governing our property be made right. <br />We leased our property to Western Fuels and they had the right to ONE mineral, Coal. They <br />bought our coal at what they claimed the going rate was and they were to mine the coal and all of <br />our soils were to be stockpiled or put back on my property. We sold the coal to them, we did not <br />sell. anything else nor did we give them permission to anything else. Our prime soils are a very <br />viable mineral. This mineral is--of COMMERCIAL value and for the approximate amount of <br />190,000 tons that they stole_ cannot be replaced or substituted without Western Fuels paying for <br />those soils. We are not accepting their solution of stealing more of our soils and moving our <br />prime soil depths of up to 72 inches to other portions of our.roperty to cover up their theft. <br />They are suppose to salvage ALL topsoil and our Barx is a prime soil and cannot be replaced <br />with a substitute. They salvaged it, then stole it. When we asked, them to stop, they refused. <br />Lance Wade the Mine manager stated that this is a' communist state and those who have, give, <br />those who don't, take. <br />We cannot grow corn under their plan and methods of irrigation, This place can never be <br />returned to furrow irrigating as they propose, and we are not going to a more intense.method of <br />irrigating with FLOOD as they propose. We will not accept less than what we had. We have <br />suggested a center pivot which will save them a lot of money in the long run. We cannot grow <br />corn under a sideroll andwe have not flood irrigated this place for 39 years and if you look at the <br />documentation you will see that even in 1960, this was furrowed and gated pipe. This, however, <br />cannot be done under their plan because of the way they put it back, furrow irrigating will no <br />longer work. <br />I am the largest stock holder of the CCC ditch and have been long before they were here. This <br />place was historically irrigated and cropped by me for 59 years and prior to that it was also <br />historically irrigated and cropped. We are not going to accept less than what we have and <br />someone s.gomp to pay for the Bars soils thst were %tote,& fmm this place- It was up to the <br />Division to enforce their Rules and Regulations and WFC needs to pay for those soils removed. <br />
