The Division has not yet completed its review of the response package. BACKFILL and GRADING—Rule 4.14 Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Stabilization of Rills and Gullies 4.14.6 • Excavation of the large initial box cut spoil pile ("Mount Nucla") located adjacent to the Support Facilities area had recently commenced. A large front-end loader was working at the northern end of the pile, loading material into haul trucks (Photo 1) for transport to the open pit on the Lloyd/WFC properties. EXPLOSIVES—Rule 4.08 Distance Prohibitions 4.08.4; Warnings 4.08.4; Control of Adverse Effects 4.08.4 • A special focus of the OSM oversight inspection was Blasting Notification, specifically the Public Notice of the blasting schedule and written notification to all governments, public utilities, and residences located within one-half mile of the permit area, as required by Rule 4.08.3 (Public Notice of Blasting Schedule). • The annual public notice appeared most recently in the April 15, 2010 publication of the San Miguel Basin Forum. Mr. Fry showed us the letters mailed to residents in 2010 and an aerial photo on which the 1/2-mile radius around the proposed blast zone was delineated. FISH and WILDLIFE—Rule 4.18 • At Pond 007, a raccoon frequently interferes with the mechanism that provides continuous monitoring of the discharge flow rate.
