The non - active use <br />areas including UTL Ponds 1 and 2, the approximate V2 acre area impacted by coal fines outside the rail loop, and <br />Topsoil Stockpile 4 footprint were all regraded, seeded, and mulched. As described previously in this inspection <br />report these four non - active use areas are stable and show no signs of erosion or instability. No problems were <br />identified with regard to revegetation considerations for the entire bond release request area. <br />Another important evaluation criterion for bond release was the establishment of the industrial /commercial post - <br />mine land use. The industrial postmine land use has been established and is being implemented at the former UTL <br />and Overland Conveyor areas for which bond release is being requested. The site is actively used and will <br />continue to be used by Halliburton Energy Services, Inc. for the unloading, storage, and shipping of construction <br />materials for their western oil and gas field operations. Halliburton has completed construction of the new <br />facilities and the Cameo Sand Storage Facility is now operational. Some of the new facilities in operation are <br />shown in attached Photograph Numbers 17 and 18. <br />Based on the implementation of the industrial land use on the "active use areas" and further based on the limited <br />extent and stable condition of the small isolated "non- active use areas ", the Division has waived the revegetation <br />requirements of 4.15.10, pursuant to 4.15.10(3). <br />Number of Partial Inspection this Fiscal Year: 2 <br />Number of Complete Inspections this Fiscal Year: 1 <br />Page 7 of 15 <br />
