September 23, 2010 C- 1981 -041 /Roadside Portals MPB <br />As previously discussed the new land owner, Halliburton Energy Services, Inc. has completed construction of the <br />new sand storage facilities and are now using the site to service the Colorado western slope oil and gas fields. <br />SCC's alternative land use reclamation plan for the Unit Train Loadout area allowed for the retention and future <br />use of the 9000+ feet of rail spur, the existing reclaim tunnel for storage, two concrete foundations to build a <br />construction field office and storage building and the existing roads. It also allowed for construction of a new <br />bridge over Coal Creek, new access road, construction of the multimillion dollar sand plant, additional railroad <br />sidings, barite storage facility and new individual septic disposal system (ISDS). The project resulted in <br />successful clean up and reclamation of the former coal loadout facility. <br />This Phase II and III bond release inspection was conducted pursuant to SCC's Bond Release Application <br />submitted July 6, 2010. Since the approved postmining land use of the release area is industrial /commercial the <br />applicable bond release criteria were evaluated pursuant to the requirements of Rule 4.15.10. The primary criteria <br />for this bond release are 1) Establishment of an industrial use of the site and evidence that the industrial use is <br />being implemented, and 2) Adequate revegetation to control erosion in non - active use areas. The UTL and <br />portions of the Overland Conveyor and Rail Spur for which bond release is sought are within an area where the <br />pre - mining land use was industrial or commercial and the approved post - mining land use is industrial /commercial. <br />Thus in accordance with 4.15.10(3) the vegetation requirement of 4.15.10(2) may be waived if requested in <br />writing by the landowner and if the Division determines that revegetation is not necessary to control erosion. In <br />SCC's bond release application, they included such request in a letter from Halliburton to DBMS dated June 22, <br />2010. Halliburton requested that the vegetation requirements of Rule 4.15.10(2) be waived on those properties <br />owned by Halliburton, as described above, due to ongoing construction projects. Future vegetation and weed <br />management issues will be regulated by Mesa County under the current Conditional Use Permit #2008 -268 CUP I. <br />We began the inspection on the morning of September 23rd by orienting the participants to the areas proposed for <br />bond release with a map and providing some historical information regarding the mining operation itself. During <br />the inspection, participants walked through the entire reclaimed UTL area, Overland Conveyor corridor, Rail Spur <br />and viewed the Permanent Flood Control Dike to allow for visual assessment of compliance with the pertinent <br />requirements described above. All bond release request areas were inspected for completion of all reclamation <br />obligations, and functioning of the reclaimed land to serve the post- mining land use. The DRMS also inspected <br />the isolated non - active use areas qualitatively for revegetation success, erosional features and "bare areas ". <br />HYDROLOGIC BALANCE -Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, <br />4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring <br />4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Ground conditions were damp due to rainfall the previous evening. We began walking east along a portion of the <br />Railroad Spur toward the reclaimed Unit Train Loadout area. A permanent road runs parallel to the train tracks on <br />the east (river) side. The Union Pacific Railroad Company uses this road. Culverts (from reclaimed UTL Ponds <br />No. 1 and 2) running underneath the rail line were capped and buried rather than disturbing the rail. No issues or <br />concerns were identified with the Railroad Spur.
